On September 14, 2023, the Brazilian Patent and Trademark Office (BPTO) announced the Public Consultation aiming at expediting patent prosecution. It is expected that, by 2026, patents will be granted within 24 months after filing in Brazil, according to the BRPTO’s Strategic Planning for 2023-2026.

As this step directly affects Articles 32 and 33 of the Brazilian Patent Law, which establishes the deadline for requesting examination and amendments to the application, the BRPTO will listen to opinions from society before changing its rules with the purpose of accelerating the technical examination of patent applications in Brazil.

The public consultation process started a few days ago and it will be possible to submit comments and suggestions until October 29, 2023, by means of a Q&A format in Portuguese language.
