ANPD publishes Cookies and Data Protection Guideline

Today (10/18), the Brazilian DPA (ANPD) published its Cookies and Data Protection Guidelines for the purpose of guiding processing agents on the best practices to be adopted on the subject, outlining points of attention regarding the rights and obligations of these agents in cookies’ processing.

In short, the material adresses: (i) important definitions and concepts, in addition to the classification of cookies based on their purpose; (ii) LGPD principles and legal aspects of the Brazilian Internet Act linked to the collection of personal data through cookies; (iii) the possibilities regarding the application of proper legal basis (consent and legitimate interest), with practical examples and (iv) the difference between cookie policy and cookie banner, in addition to cookie banner suggestions according to the published study.

Keeping its commitment to data protection education, the Authority also reinforces the possibility of contributions from society on the subject on an ongoing basis, which must be sent to the ANPD Ombudsman through the Fala.BR Platform.
