On April 19, 2022, the Brazilian PTO published in Industrial Property Journal #2676 the suspension of the applicability of the Technical Note BRPTO/CPAPD #01/2022 of March 2022, which was directed to clarify the patentability requirements for inventions related to transgenic plants, especially elite events.
In order to allow the technical contribution of the public, the Brazilian PTO will open a Public Consultation regarding this matter. In view of this, the provisions of said Technical Note is suspended until the end of the Public Consultation.
