Raid action against trademark infringement. Daniel Law was retained by a multinational tech company in 2020 to support its anti-counterfeiting program. This case involved a raid at the store of Ronaldo Variedades to seize counterfeit products. The store was distributing (retail and wholesale) counterfeit products bearing the client’s trademarks and industrial design. The way our team differentiates itself is that we conduct proactive investigations all over Brazil to identify to the most important targets for our clients. In this case, we identified the infringer with the highest potential volume of counterfeit products to seize. We submitted a motion detailing the crime of counterfeiting, and the Federal Revenue and Specialized Police against Consumer Crimes Units in Bahia State were called upon to conduct the raid in the city of Salvador.
Unauthorized trademark use: We seized over 50,000 counterfeit products infringing the client’s trademarks and industrial design, causing confusion, deception and mistake about the source of these products.
We were able to seize more goods also due to our strategy of supporting our rights to existing industrial designs, something that had been overlooked by the other firm.
Stopping large-scale counterfeit supplier in Brazil: The wholesaler Ronaldo Variedades was one of the most important suppliers of counterfeit products in all the Northeast of Brazil.
Latest development: The Federal Revenue and the Specialized Police will keep the administrative procedure until we have a final decision from the Criminal Judge requesting the destruction of those items.
