Patent Prosecution Highway (PPH) Nears 2024 Limit

The effectiveness of the acceleration program serves as a warning to seize the last opportunities

The first half of the year is almost over, and the National Institute of Industrial Property (INPI) has announced that the global limit for technical examination acceleration requests through the Patent Prosecution Highway (PPH) program is nearing its cap for 2024. As stipulated in INPI/PR Ordinance No. 78/22, the PPH currently has a limit of 800 requests per annual cycle, which ends on 12/31/2024. After this date, the limit is reset. According to the agency, as of June 5th, 678 requests had been made, with Daniel being responsible for approximately 15% of the requests submitted to the INPI. The project, initiated in 2015 and expanded over time, is part of INPI’s ongoing efforts to combat the backlog.

“INPI limits the number of acceleration requests for patent application examinations under the PPH program. Currently, this limit is 800 requests, and if reached, INPI will no longer accept requests for the year. In January 2025, this limit will be reset,” declares Gustavo Sartori, Partner at Daniel.
