On December 13, 2024, the European Patent Office (EPO) and Costa Rica’s Ministry of Justice and Peace signed a landmark validation agreement that will allow European patents to be recognized as national patents in Costa Rica upon payment of a validation fee. This marks a significant step in strengthening intellectual property protection and fostering innovation and investment in Latin America.

Key Highlights:

• First in the Americas: Costa Rica is the first country in the Americas to sign such an agreement, joining Morocco, Moldova, Tunisia, Cambodia, Georgia, and Laos as validation partners of the EPO.
• Streamlined Market Access: Once the agreement comes into force, European patent holders will enjoy simplified access to the Costa Rican market, promoting trade, technology transfer, and foreign direct investment.
• Wide Coverage: With this agreement, and the anticipated entry into force of the Laos agreement, a single European patent application will potentially cover up to 47 countries.

While the effective date of the agreement has not yet been announced, Daniel Law is monitoring developments closely to assess the strategic opportunities this new framework offers.
