Chile approves Standard Contractual Clauses for international transfers

In approving Standard Contractual Clauses for international transfers, Chile follows with the standard set by other data protection regulations in the European Union and Latin America. The country’s new personal data protection law (Law No. 21,719/24) allows international transfers to countries with data protection standards similar to or higher than those required by Chilean law, or if the receiving country offers guarantees that provide similar levels of protection, such as Standard Contractual Clauses.

The new law will only come into force in December 2026, but to provide greater legal certainty to businesses that will need to comply with its rules, Chile has established a Ministerial Advisory Commission to the Ministry of the Economy. The body will assist in the implementation of the future Personal Data Protection Agency and in creating the essential regulations needed before the new law takes effect. Among these actions, the Ministry of Economy approved Standard Contractual Clauses to facilitate international transactions with Chile.

The document cites as one of its objectives facilitating data transactions with countries such as the United States and other countries in Latin America, pointing to the model of the Ibero-American Network’s Standard Contractual Clauses, widely used in Latin America and approved by authorities in countries such as Argentina, Uruguay, and Peru.
