Brazilian PTO opens Public Consultation on Technical Note BRPTO/CPAPD #01/2022, regarding the patentability of inventions associated with transgenic plants, especially elite events

On June 01, 2022, the Brazilian PTO announced, through Official Gazette #103, that the Public Consultation on Technical Note BRPTO/CPAPD #01/2022 is open.

As previously reported, this Public Consultation aims to discuss the content of said Technical Note, which is directed to clarify the patentability requirements for inventions related to transgenic plants, especially elite events.

Interested Parties will have until July 01, 2022 to submit suggestions and comments regarding said Technical Note before the BRPTO. At the end of this deadline, the BRPTO will present a response to the suggestions and comments received, as well as a final version of said Technical Note.

Therefore, the application of Technical Note BRPTO/CPAPD #01/2022 remains suspended until the end of the Public Consultation.
