Brazil Establishes National Policy for the Conservation and Sustainable Use of Genetic Resources

New measure aims to preserve and sustainably use genetic resources, promoting food security and innovation

Decree No. 12,097, dated July 3, 2024, established the National Policy for the Conservation and Sustainable Use of Genetic Resources for Food, Agriculture, and Livestock. This policy aims to preserve and sustainably use genetic resources essential for our food and agriculture, promote food security, healthy eating, and expand knowledge about these resources.

Guidelines and Objectives
The main objectives include:

  • Conservation and Sustainable Use: Promote the conservation, sustainable use, protection, and enhancement of genetic resources.
  • Food Sovereignty: Ensure food sovereignty and nutritional security.
  • Knowledge and Innovation: Expand knowledge and appreciation of genetic resources, and support genetic improvement programs.

The policy will be implemented in cooperation with states, the Federal District, municipalities, civil society organizations, and private entities. Guidelines include promoting sustainable and innovative practices, documenting and making scientific data available, and training human resources.

Policy Instruments
The instruments include:

  • National Genetic Resources Platform: Integrating the National Genetic Resources Network and the National Information System on Genetic Resources.
  • National Conservation Programs: Ex situ, in situ, and on farm, coordinated by different ministries according to their competencies.
Governance and Implementation
Governance will be carried out by a Management Committee established by interministerial ordinance, ensuring equal participation between government and civil society, and it is guaranteed the participation of indigenous peoples, traditional peoples and communities, and family farmers.. Additionally, the Ministries of Agriculture and Livestock, Agrarian Development and Family Agriculture, and Environment and Climate Change may issue complementary regulations within their competencies.

Viviane Kunisawa, partner in the regulatory area at Daniel Law, highlights the importance of this new policy for promoting sustainability and innovation in the Brazilian agricultural sector. “The National Policy for the Conservation and Sustainable Use of Genetic Resources is a significant milestone for promoting sustainable practices and valuing genetic resources in Brazil, aligning with global goals for sustainable development and biodiversity conservation,” says Kunisawa.
