The Brazilian Patent and Trademark Office (BPTO) announced on Monday (18) the launch of Public Consultation No. 03/2025, aimed at collecting public contributions on the draft Guidelines for the Examination of Patent Applications related to Artificial Intelligence.
The participation period runs from August 18 to October 17, 2025, totaling 60 days from the publication in the Official Gazette of the Federal Government. Submissions must be sent exclusively through the electronic form available on the official link (in Portuguese only), following the indicated fields and restricted to the proposed subject.
Once the consultation period closes, the BPTO will review and consolidate all contributions received. The public notice was also published on the Participa + Brasil platform, reinforcing the Office’s commitment to an open and transparent process.
Experts highlight the relevance of the debate
According to Gustavo Sartori, partner at Daniel Law and specialist in Industrial Property, the initiative represents a decisive step in aligning the BPTO’s practices with technological transformations:
“The debate on examination guidelines for artificial intelligence is fundamental. This is a rapidly evolving field that brings complex technical and legal challenges. The public consultation allows different stakeholders – from researchers and companies to legal professionals – to contribute to the development of clear and modern criteria, ensuring legal certainty and fostering innovation”, says Sartori.
He also notes that this openness to dialogue reflects an international trend:
“Patent offices around the world are discussing how to address inventions in artificial intelligence. By launching this consultation, Brazil signals that it is attentive and committed to establishing solid parameters to keep pace with this evolution” he adds.
