Decisions from courts and the INPIs themselves (like INPI Brazil) on this topic are constantly evolving, and vigilance is fundamental to protect your marketing investment.

To effectively combat these infringements, your brand needs a robust and, above all, proactive online enforcement strategy:

  • Technological Monitoring: Invest in tools with artificial intelligence and algorithms to track the unauthorized use of your brand online at scale. It’s like having a 24/7 vigilant team.
  • Rapid Notification Flow: Establish a well-defined protocol for sending infringement notices directly to platforms, requesting content removal. Speed is everything here.
  • Strategic Judicial and Administrative Actions: When friendly notifications don’t work, it’s necessary to escalate. Having the support of specialized lawyers for administrative proceedings at local IP offices or judicial actions is crucial.

Remember: your enforcement strategy needs to consider the territoriality of rights (acting locally via the INPIs and courts in countries like Brazil, Mexico, Chile, and Colombia), but also leverage global tools to combat cross-border counterfeiting networks.
