Brazilian PTO announces additional clarifications on the implementation of Sequence Listing files in Standard ST.26

Continuing our previous communications on the transition of Sequence Listing files from Standard ST.25 (.txt) to the Standard ST.26 (.xml) for patent applications, the Brazilian PTO officially confirmed today that:

(I) for new patent applications, all Sequence Listing files must be submitted in the new format (.xml) as of July 1st, 2022; and
(II) for pending patent applications encompassing the Sequence Listing file in ST.25 (.txt) and filed before the Brazilian PTO until June 30, 2022, must maintain this format, even in case of future amendments.

Finally, to assist in the implementation of Standard ST.26, WIPO developed WIPO Sequence software, which enables the Applicant to create, edit and verify a Sequence Listing file in .xml format.
